{"id":9305,"date":"2025-11-06T10:26:35","date_gmt":"2025-11-06T02:26:35","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=9305"},"modified":"2025-11-06T10:26:35","modified_gmt":"2025-11-06T02:26:35","slug":"agoda-layoffs-severance-deals-should-not-deter-staff-from-reaching-authorities-says-tan-see-leng","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=9305","title":{"rendered":"Agoda layoffs: Severance deals should not deter staff from reaching authorities, says Tan See Leng"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">SINGAPORE \u2013 <!-- -->Severance agreements should never include clauses that discourage or inhibit employees from approaching the authorities under any circumstances, Manpower Minister Tan See Leng said in a written parliamentary reply on Nov 5.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">He was responding to questions from Non-Constituency MP Andre Low regarding travel booking platform <a href=\"https:\/\/www.straitstimes.com\/business\/agoda-axes-50-employees-in-singapore-as-part-of-larger-retrenchment-exercise-bt?ref=inline-article\" rel=\"nofollow noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">Agoda\u2019s recent<\/p>\n<p><\/a><a href=\"https:\/\/www.straitstimes.com\/business\/agoda-axes-50-employees-in-singapore-as-part-of-larger-retrenchment-exercise-bt?ref=inline-article\" rel=\"nofollow noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><a href=\"https:\/\/www.straitstimes.com\/business\/agoda-axes-50-employees-in-singapore-as-part-of-larger-retrenchment-exercise-bt?ref=inline-article\" rel=\"nofollow noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">retrenchment exercise<\/p>\n<p><\/a>, which affected about 50 employees.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Dr Tan said that besides the Agoda case, his ministry has not received any related complaints over the past three years. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Low had asked about the number of complaints the Ministry of Manpower (MOM) had received over the last three years regarding severance agreements that contain clauses discouraging staff from approaching the authorities or unions. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">He also asked whether there are proactive monitoring or existing audit mechanisms to prevent the inclusion of clauses that undermine a worker\u2019s right to seek redress in severance agreements.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Dr Tan said the Government is mindful not to \u201cover-regulate\u201d and be intrusive when it comes to private agreements between employers and workers, even as it empathises with employees\u2019 concerns over inappropriate clauses<!-- -->, such as those stopping them from reaching out to the authorities for help and guidance<!-- -->.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cMOM does not proactively monitor severance agreements, as such contracts between firms and workers are private and confidential. However, if we receive complaints on the severance agreements, we will investigate the matter,\u201d he said.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">In September, affected Agoda staff were told not to report the retrenchment to MOM, other government agencies and trade unions, according to a severance document that was circulated on social media. The document, which stated that those\u00a0who did report it would\u00a0have their severance benefits revoked, has drawn widespread public criticism.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Dr Tan noted that the tripartite partners were made aware of the inappropriate clause only through media coverage. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Employers are not required to submit the mandatory retrenchment notification before retrenching workers, he said, but the National Trades Union Congress has proposed that the Government consider requiring advance notification to better assist affected workers.  <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\"><a href=\"https:\/\/www.straitstimes.com\/business\/agoda-admits-restricting-workers-access-to-unions-authorities-was-inappropriate-says-ntuc?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">Agoda has since apologised and admitted it was inappropriate<\/p>\n<p><\/a> to discourage employees from seeking help from the relevant authorities and unions after retrenchment.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Dr Tan added that MOM works with tripartite partners to encourage employers to conduct their retrenchment exercises fairly and responsibly. \u201cThis includes providing sufficient time for affected workers to consider the severance agreement offered so that they can seek their own independent legal advice if necessary.\u201d<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">There are also clear and accessible channels for employees to seek redress where required, he added. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cShould workers encounter unfair or illegal clauses in their severance agreements, they may approach MOM or Tripartite Alliance for Fair and Progressive Employment Practices. MOM takes a serious view of such clauses and will not hesitate to take action against errant employers where necessary,\u201d he said. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Reports of sudden layoffs affecting several businesses have surfaced recently, including home-grown confectionery chain Twelve Cupcakes, which retrenched about 80 staff after the company was placed under provisional liquidation in late October. MOM is <a href=\"https:\/\/www.straitstimes.com\/business\/companies-markets\/twelve-cupcakes-under-mom-probe-for-unpaid-salaries-abrupt-retrenchment-of-80-staff?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">investigating the company<\/p>\n<p><\/a> for non-payment of salaries and other potential breaches. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Art investment firm Art Works <a href=\"https:\/\/www.straitstimes.com\/business\/art-firm-closure-leaves-staff-unpaid-lawyers-urge-them-to-file-claims-and-focus-on-job-hunt?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">has also gone into liquidation<\/p>\n<p><\/a>, leaving about 15 staff with unpaid salaries, CNA reported on Nov 4.
