{"id":9021,"date":"2025-11-05T10:24:32","date_gmt":"2025-11-05T02:24:32","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=9021"},"modified":"2025-11-05T10:24:32","modified_gmt":"2025-11-05T02:24:32","slug":"pritam-singh-appeal-credibility-of-witnesses-in-the-spotlight-as-wp-chief-appeals-against-conviction","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=9021","title":{"rendered":"Pritam Singh appeal: Credibility of witnesses in the spotlight as WP chief appeals against conviction"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">SINGAPORE \u2013\u00a0<!-- -->The <a href=\"https:\/\/www.straitstimes.com\/singapore\/wp-chief-pritam-singh-to-appeal-conviction-sentence-on-nov-4?ref=inline-article\" rel=\"nofollow noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">appeal launched by Leader of the Opposition Pritam Singh<\/p>\n<p><\/a> was heard on Nov 4, with the defence arguing that the trial judge had \u201cignored crucial pieces of evidence\u201d in convicting Singh of <a href=\"https:\/\/www.straitstimes.com\/singapore\/courts-crime\/wp-chief-pritam-singh-fined-7000-for-each-of-two-charges-after-conviction-for-lying-to-committee?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">lying under oath<\/p>\n<p><\/a> to a parliamentary committee. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">High Court Justice Steven Chong, who reserved his judgment for a future date, said Singh\u2019s appeal centred on findings made by the trial judge on <!-- -->two statements<!-- --> that the WP secretary-general had made during meetings with former MP Raeesah Khan on Aug 8 and Oct 3, 2021. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Singh had, on Feb 17, been convicted of two charges of lying to the Committee of Privileges (COP) about his role in advising <a href=\"https:\/\/www.straitstimes.com\/singapore\/politics\/wp-mp-raeesah-khan-referred-to-parliament-privileges-committee-for-lying-about?ref=inline-article\" rel=\"nofollow noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">Ms Khan to conceal an untruth to Parliament,<\/p>\n<p><\/a> and was fined $14,000. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Justice Chong said the first statement related to Singh asking Ms Khan to take her lie \u201cto the grave\u201d at the Aug 8 meeting. The Workers\u2019 Party chief had consistently denied saying this. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The second statement was what Singh told Ms Khan at their Oct 3 meeting: \u201cI will not judge you.\u201d While the prosecution and defence agreed that Singh did say this, they disagree on what he meant. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The one-day hearing threw the spotlight on the credibility of witnesses who had testified during the earlier 13-day trial, including Singh himself, Ms Khan, and her two former WP aides. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Singh\u2019s lawyer, Mr Andre Jumabhoy, began the hearing by calling into question Ms Khan\u2019s credibility, arguing that she had provided different accounts of the Aug 8 meeting. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">At the meeting, which took place at Singh\u2019s house, Ms Khan had confessed her lie to the party\u2019s leaders \u2013 Singh, WP chairwoman Sylvia Lim and vice-chairman Faisal Manap. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The then Sengkang MP had lied about accompanying a sexual assault victim to a police station, and later repeated the false claim before the House on Oct 4 the same year. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Immediately after the meeting, Ms Khan had texted her aides \u2013 Ms Loh Pei Ying and Mr Yudhishthra Nathan \u2013 that the WP leaders had agreed she should take her lie to the grave. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Jumabhoy said Ms Khan had given three different accounts of the meeting before the COP and at Singh\u2019s trial, including one instance when there was no suggestion that Singh had asked her to take the lie to the grave.   <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cEveryone can see that there are differences, and to pretend that there is no difference does a disservice,\u201d Mr Jumabhoy said.   <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The judge countered that the fact that Ms Khan might not have used the phrase \u201ctake it to the grave\u201d consistently in the three versions did not mean it was not said. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Justice Chong asked the defence to explain why Singh appeared to be \u201cdoing nothing\u201d to help Ms Khan come clean between Aug 8, 2021, and their second meeting on Oct 3, 2021. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Jumabhoy said Singh\u2019s position was that, at some point, Ms Khan would need to clarify the lie. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The defence counsel said Singh\u2019s inaction was due to there being more pressing matters to deal with at that time, including an important Bill the House was going to discuss on Oct 4, as well as other party matters and personal issues involving his children. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The judge noted that there was \u201ca complete absence of any discussion\u201d during those eight weeks, and questioned if Singh was so busy that he did not deal with this pressing matter of an MP\u2019s lie in Parliament. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Jumabhoy also sought to show that Ms Khan and her aides were inconsistent witnesses. He pointed to how Ms Loh and Mr Nathan had asked Ms Khan to continue with her lie, and later made false justifications to redact these messages after they were tendered to the COP as evidence. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">In contrast, Deputy Attorney-General Goh Yihan told the court that Singh\u2019s inaction and the multiple pieces of corroborative evidence \u2013 Ms Khan\u2019s message, as well as Ms Loh\u2019s and Mr Nathan\u2019s evidence \u2013 showed that the WP chief never intended for Ms Khan to clarify her lie in Parliament. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cThis radio silence speaks volumes&#8230; the fact that he did not follow up must lead to the natural inference that there was nothing to follow up at all,\u201d he said. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">At his trial, Singh himself had acknowledged that he had said \u201cI will not judge you\u201d to Ms Khan, but disputed the context in which the phrase was used. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">This conversation took place at Ms Khan\u2019s house on Oct 3, 2021, with no one else within earshot. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Ms Khan took the statement to mean Singh would not judge her for continuing the narrative in Parliament on Oct 4, 2021. Singh\u2019s position was that he told Ms Khan that he would not judge her, and that she \u201cwould have to take ownership and responsibility\u201d in coming clean. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Justice Chong said the question is what this meant \u201cto two intelligent, well-educated persons\u201d. \u201cThis is not a term of art,\u201d he said, referring to a phrase with a specialised meaning within a profession. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cIt will be odd to say \u2018I will not judge you\u2019 when the context is that the person is going to do the right thing. That is how I would objectively judge those words,\u201d said the judge. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Jumabhoy replied that it was not quite as clear-cut as the judge had made it seem and argued that the statement could be interpreted either way. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">DAG Goh said there were five key pieces of evidence corroborating the second charge, just as there was in relation to the first charge. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Among other things, Ms Khan had, on Oct 7, 2021, e-mailed the WP leaders to thank them for guiding her without judgment, and Singh had not taken any action when Ms Khan doubled down on the lie on Oct 4, he noted. Ms Lim had also recorded Singh saying at a WP disciplinary hearing in November 2021 that it was Ms Khan\u2019s call as to what to do about her lie. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Earlier in the day, the judge asked the defence why Singh had not confronted Ms Khan about repeating the lie on Oct 4, which would have been a normal reaction to a matter like this with political repercussions. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Jumabhoy replied that \u201cshouting, screaming, losing your temper is not going to change the situation\u201d, and said it was the defence\u2019s case that Singh had on Oct 3 told Ms Khan that she had to come clean if the matter came up in Parliament. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">DAG Goh said that by Singh\u2019s own evidence, he did not castigate Ms Khan for repeating the lie on Oct 4, which was inconsistent with someone who had told her she needed to clarify the issue that day. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">In written submissions to Justice Chong, the prosecution said the defence had \u201craised an unfocused scattershot of overlapping complaints, amounting to a total of 61 grounds of appeal\u201d. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The trial judge who convicted Singh had conducted a scrupulous trial, accurately evaluated the evidence, and applied the law correctly, it added. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cHis findings that (Singh) wilfully gave false answers to the COP \u2013 in essence, that (he) lied to cover up his role in advising a fellow MP to conceal a lie \u2013 are overwhelmingly supported by the evidence,\u201d said the prosecution. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">In the defence\u2019s written submissions, Mr Jumabhoy said the convictions against Singh were \u201cbuilt on a foundation of unspoken words, unsupported assumptions, and the shifting testimonies of discredited and incredible witnesses\u201d. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">He said Ms Khan\u2019s account was the sole foundation of both charges, even though she was \u201cevasive under cross-examination and, when she was cornered, fabricated completely fantastical evidence which, for reasons unfathomable, the (trial judge) accepted as true\u201d. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The charges against Singh \u201crested on a patchwork of words, loosely stitched together, retrofitted into a narrative that (Singh) himself never gave\u201d, he added. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Speaking to a clutch of reporters outside the High Court after the hearing, Singh said he would comment on his case only after a judgment was made. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cLet\u2019s allow the court to review the submissions and the arguments that were made by the defence, and of course the prosecution,\u201d he
