{"id":8865,"date":"2025-11-04T19:19:42","date_gmt":"2025-11-04T11:19:42","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=8865"},"modified":"2025-11-04T19:19:42","modified_gmt":"2025-11-04T11:19:42","slug":"workplace-fairness-laws-on-track-to-take-effect-from-end-2027-tan-see-leng","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=8865","title":{"rendered":"Workplace fairness laws on track to take effect from end-2027: Tan See Leng"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">SINGAPORE \u2013<!-- --> Landmark workplace fairness laws are now slated to take effect from end-2027, Minister for Manpower Tan See Leng told Parliament on Nov 4.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">This narrows down the laws\u2019 implementation to the tail end of a launch window of 2026 or 2027 announced previously.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cWe have heard feedback from various stakeholders. (The Ministry of Manpower) recognises that ample preparation is critical for successful implementation<!-- -->,\u201d Dr Tan said in a speech to introduce the Workplace Fairness (Dispute Resolution) Bill for i<!-- -->ts second reading.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The lead time is needed for employers to review their processes, and workers to know their rights and what constitutes a legitimate discrimination claim, he said.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cWe will also need time to ensure our mediators are well-trained to effectively facilitate workplace discrimination cases,\u201d he said, adding that the timeline may still be adjusted if needed.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The Bill sets out the framework and related safeguards for resolving workplace fairness disputes, including claim limits, and the entities disputing parties engage with at each step.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">It is the second of two that together form the upcoming workplace fairness laws.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The earlier Workplace Fairness Act, <a href=\"https:\/\/www.straitstimes.com\/singapore\/politics\/landmark-bill-tackling-workplace-discrimination-passed-in-parliament?ref=inline-article\" rel=\"nofollow noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><\/p>\n<p class=\"font-body-baseline-regular inline\" data-testid=\"paragraph-test-id\">which was passed in January,<\/p>\n<p><\/a> prohibits discrimination on the basis of age; nationality; sex, marital status, pregnancy status and caregiving responsibilities; race, religion and language; and disability and mental health conditions. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">In his speech, Dr Tan spoke on how the second Bill is intended to encourage amicable resolution, first via companies\u2019 internal grievance handling process, before embarking on mediation.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">On mediation, he noted that workplace fairness disputes can be brought to the Employment Claims Tribunals (ECT) or the High Court for adjudication only as a last resort should mediation fail.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Dr Tan then outlined moves to build up the capabilities of mediators to deal with complex, higher-value disputes above $30,000.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The Government will appoint other mediation service providers, such as the Singapore Mediation Centre, to handle such higher-value claims. <\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Currently, the Tripartite Alliance for Dispute Management (TADM) handles compulsory mediation for salary and unfair dismissal claims of up to $20,000, or up to $30,000 for unionised workers.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Dr Tan said TADM mediators will also receive customised training on a host of mediation approaches to deal with complex workplace discrimination disputes, as well as inclusivity and sensitivity training.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cWe will set more stringent requirements on mediators for higher-value claims, including possessing legal qualifications or having relevant experience mediating employment disputes.\u201d<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">He also elaborated on the decision to expand the ECT\u2019s jurisdiction to hear workplace discrimination claims of $250,000 and under, far higher than the existing limit of $30,000 for salary and unfair dismissal claims.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The high limit is to ensure the vast majority of cases needing adjudication, including those involving professionals, managers and executives who earn higher salaries, are heard by the ECT.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The ECT provides affordable, accessible and swift resolution through a judge-led process in which judges guide parties on the issues in contention and the evidence needed, where lawyers are not allowed, Dr Tan said.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">He added<!-- -->: \u201cThe expansion of the ECT\u2019s monetary jurisdiction does not mean that we expect workplace discrimination claims to be of higher value than other employment claims today.\u201d<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">However, higher-value claims above $250,000 are better heard by senior judges on the High Court bench, with legal representation, Dr Tan said.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cThis is also the case for other types of high-value employment claims today. I do not expect many workplace discrimination claims to be commenced in the High Court.\u201d<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Most cases at the ECT are resolved within six months, while employment-related cases in the State Courts are resolved within 18 months, Dr Tan noted.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Addressing concerns of frivolous and vexatious claims, Dr Tan said employers will be able to apply for such claims to be struck out by judges.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Judges will also be empowered to strike out claims.
