{"id":84892,"date":"2026-09-14T18:25:00","date_gmt":"2026-09-14T10:25:00","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=84892"},"modified":"2026-09-14T18:25:00","modified_gmt":"2026-09-14T10:25:00","slug":"law-to-safeguard-social-cohesion-to-take-effect-on-sept-15","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=84892","title":{"rendered":"Law to safeguard social cohesion to take effect on Sept 15"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"text-primary article-summary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">SINGAPORE \u2013 <!-- -->A law that\u00a0consolidates existing statutes to preserve racial harmony while providing for additional safeguards\u00a0will come into operation on Sept 15.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">At the same time, a new Presidential Council for Racial and Religious Harmony (PCRRH) will begin its inaugural three-year term, replacing the previous Presidential Council for Religious Harmony.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The Maintenance of Racial Harmony Act <a href=\"https:\/\/www.straitstimes.com\/singapore\/politics\/new-law-to-protect-racial-harmony-passed?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><span class=\"inline font-tertiary-body-baseline-regular\" data-testid=\"typography-test-id\">was passed by Parliament on Feb 4, 2025,<\/span><\/a> and empowers the Government to issue restraining orders (ROs) against individuals involved in making content that prejudices Singapore\u2019s racial harmony.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">It also introduces a community remedial initiative, which gives those who have committed less egregious race-related offences a chance to mend community ties in lieu of prosecution.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">In a statement on Sept 14, the Ministry of Home Affairs (MHA) said the new law strengthens Singapore\u2019s ability to preserve racial harmony, respond effectively to emerging threats, and safeguards the city-state\u2019s multicultural society against malicious foreign influence.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The Act takes close reference from the existing Maintenance of Religious Harmony Act (MRHA) which, besides providing for powers to issue ROs, requires religious groups here to comply with leadership restrictions and to declare foreign funding and affiliations with foreign groups.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The racial harmony law means that some 300 clan and business associations here to be designated as \u201crace-based entities\u201d are subjected to similar disclosures. MHA said it will guide designated entities on their reporting requirements ahead of their first reporting obligation in April 2028.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">At the Feb 2025 debate over the law, then Law and Home Affairs Minister K. Shanmugam told Parliament that the best evidence for how the authorities were likely to use the new powers was in their use of the MRHA, which was enacted in 1990.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Shanmugam noted that no orders had been issued under the MRHA to date, but the legal framework meant everyone understood what was not allowed in Singapore.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">\u201cThat gives you an indication of how the Government approaches these powers. The important thing is to have the powers, but also to be very, very careful and judicious in how you use them,\u201d he said then.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Under the new law, the Minister for Home Affairs can issue ROs against individuals who produce, distribute, or communicate content that prejudices racial harmony.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">A person issued an RO could be prohibited from from communicating or distributing specified material and to take all reasonably practicable steps to ensure that such material is no longer available to the general public in Singapore, among other things.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">After an RO is issued, it must be sent to the PCRRH for review, and any persons subject to an RO may make representations to the council.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The PCRRH\u2019s independent recommendation on the RO will thereafter be sent to the president, followed by the Cabinet\u2019s advice to the president.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The president must then consider the council\u2019s recommendation, along with Cabinet\u2019s advice, before deciding whether to cancel, confirm or vary the RO. The president must act in accordance with Cabinet\u2019s advice, but he has discretion if the Cabinet disagrees with the PCRRH.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">On Sept 14, the President\u2019s Office announced that President Tharman Shanmugaratnam had appointed the PCRRH, which will comprise 12 representatives.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The council will be chaired by retired Supreme Court judge Choo Han Teck, and its members are:<\/p>\n<div class=\"article-list-container\" data-testid=\"bulleted-article-list-test-id\">\n<ul class=\"pl-22 list-disc article-list-wrapper\">\n<li class=\"article-list-item list-item\" data-testid=\"bulleted-article-list-item-test-id\">\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Seck Kwang Phing, president of the Singapore Buddhist Federation<\/p>\n<\/li>\n<li class=\"article-list-item list-item\" data-testid=\"bulleted-article-list-item-test-id\">\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">K.
