{"id":74353,"date":"2026-08-05T09:28:05","date_gmt":"2026-08-05T01:28:05","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=74353"},"modified":"2026-08-05T09:28:05","modified_gmt":"2026-08-05T01:28:05","slug":"dismissing-staff-on-probation-what-employers-need-to-know","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=74353","title":{"rendered":"Dismissing staff on probation: What employers need to know"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">SINGAPORE \u2013 <!-- -->While dismissal of staff on probation is permitted under<!-- --> <!-- -->Singapore\u2019s employment law, experts say employers who cite poor performance as the reason must be ready to back it up<!-- --> <!-- -->with proper documentation.\u00a0<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">This advice is underscored by a recent case in which the Employment Claims Tribunals<!-- --> <!-- -->(ECT) awarded a woman the maximum $30,000 compensation <a href=\"https:\/\/www.straitstimes.com\/business\/tribunal-awards-woman-maximum-30000-over-sudden-and-unjustified-probation-dismissal?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><span class=\"inline font-tertiary-body-baseline-regular\" data-testid=\"typography-test-id\">for her \u201csudden and unjustified\u201d dismissal<\/span><\/a> just before her six-month probation was up.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">She was told her performance had fallen short of the standards required for confirmation and was given two weeks\u2019 notice. She then filed a wrongful dismissal claim.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The magistrate concluded that the employer had failed to justify its decision that the woman, an audit manager, had not passed probation.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The court ruling has raised concerns among employers about the potential legal risks of dismissing employees on probation.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Ministry of Manpower (MOM) data showed there were <a href=\"https:\/\/www.straitstimes.com\/business\/salary-wrongful-dismissal-claims-up-in-2025-hit-highest-levels-since-at-least-2019?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><span class=\"inline font-tertiary-body-baseline-regular\" data-testid=\"typography-test-id\">2,168 wrongful dismissal claims in 2025<\/span><\/a>, although it did not provide a breakdown of cases filed by employees on probation.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Human resources (HR) professionals said dismissals during probation are relatively rare.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Akshay Mendon, director of leadership hiring at global executive search firm Mercuri Urval, said: \u201cCompanies do spend a lot of time and money on hiring, so in my experience, they do try to retain employees and make things work, within reason.\u201d<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Juliet Tan, founder of HR consultancy firm Emplifi, also noted that for most organisations, failing probation remains the exception rather than the rule.<\/p>\n<h2 class=\"font-primary-headline-md-semibold\" data-testid=\"article-subhead-test-id\">The importance of documentation<\/h2>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Nonetheless, the ECT\u2019s ruling <!-- -->decision <!-- -->acts as a reminder for employers to provide proper documentation to protect themselves against claims of wrongful dismissal.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">HR professionals said employers should also provide regular feedback, giving employees enough time and opportunity to improve, instead of waiting until the end of the probation period to <!-- -->raise concerns.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Subjective comments such as \u201cnot committed enough\u201d or \u201cnot the right fit\u201d may be difficult to defend if the expected standards were never clearly explained, said Yvonne Tan, director of recruitment agency Dynamic Human Capital, a subsidiary of manpower consultancy Elitez Group.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">She added that written records of performance discussions, together with a fair process, will help protect the company if the dismissal is later challenged by affected employees. This entails providing examples of missed expectations, detailing the support or mentorship provided, and allowing employees to respond before a final decision is made.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">In addition to keeping proper documentation, Mendon said, companies need to be \u201cvery careful\u201d about how this is communicated to the employee.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">For example, he recommended flagging performance issues early \u2013 say, in the first month \u2013 addressing them quickly, documenting the feedback, being clear on what needs to be improved, and setting a date to review progress.<\/p>\n<h2 class=\"font-primary-headline-md-semibold\" data-testid=\"article-subhead-test-id\">Who can file the claim<\/h2>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Not every employee<!-- --> on probation<!-- -->, however, is eligible to bring a wrongful dismissal claim. Eligibility depends on factors such as an employee\u2019s role and length of service.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Under the Employment Act, managers and executives must complete at least six months of continuous service to qualify for wrongful dismissal claims, unless they are let go without notice and without salary <!-- -->in lieu of notice.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">This group includes employees with executive and supervisory responsibilities, such as formulating business strategies and managing operations, as well as professionals with specialised skills, such as advocates and solicitors, and chartered accountants.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">Non-managers and non-executives are not subject to a minimum service requirement.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">In the case of the audit manager, she was eligible to file a wrongful dismissal claim because she had worked for the employer for six months and 10 days.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The Singapore National Employers Federation (SNEF) said the six-month threshold was agreed by the tripartite partners because \u201cmanagerial and executive roles often require a longer period for employers to assess an employee\u2019s suitability, job fit and performance before making a decision on continued employment\u201d.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">The six-month threshold has also proven decisive in another ruling published on Aug 3. In this case, <a href=\"https:\/\/www.straitstimes.com\/business\/manager-loses-wrongful-dismissal-case-after-tribunal-rules-he-was-not-a-relevant-employee?ref=inline-article\" rel=\"noopener\" class=\"gap-x-04 items-center inline text-primary-60 select-auto\" aria-label=\"link\" target=\"_blank\" data-testid=\"custom-link\"><span class=\"inline font-tertiary-body-baseline-regular\" data-testid=\"typography-test-id\">a software manager failed in his wrongful dismissal claim<\/span><\/a> after the court found that he was not a \u201crelevant employee\u201d, for he had served for only five months and 27 days, and was paid salary in lieu of notice.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">However, <!-- -->Yvonne<!-- --> Tan of Dynamic Human Capital cautioned that the six-month rule is \u201cnot a free pass\u201d for employers to terminate employees before<!-- --> <!-- -->the six-month mark.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">She said: \u201cThe decision should be based on legitimate reasons, supported by proper documentation, and not made simply to avoid potential claims.\u201d<\/p>\n<h2 class=\"font-primary-headline-md-semibold\" data-testid=\"article-subhead-test-id\">When to extend probation<\/h2>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">When employers need more time to assess an employee, extending the probation period may be a better option than making a premature decision, HR professionals said.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">This may be appropriate when onboarding has been disrupted or when an employee is showing signs of improvement, said Tan.<\/p>\n<p class=\"text-primary font-tertiary-body-baseline-regular\" data-testid=\"article-paragraph-annotation-test-id\">\u201cIt should not be used simply to delay a difficult decision.
