PETALING JAYA: The Malaysian Anti-Corruption Commission (MACC) will appeal the dismissal of the restraining order on RM548mil in several bank accounts in Singapore.<\/p>\n
The funds are said to belong to Toh Puan Na’imah Abdul Khalid, her son and seven others.<\/p>\n
“The MACC takes note of the decision of the Kuala Lumpur High Court today, (May 22) which dismissed the prosecution\u2019s application for a restraining order on investment funds amounting to RM548mill held in bank accounts in Singapore, allegedly owned by Toh Puan Na\u2019imah Abdul Khalid, her son, and seven other parties,” the MACC said in a statement Friday (June 22).<\/p>\n
“Following the decision, the MACC will file a notice of appeal in the near future, and the matter has been brought to the attention of the attorney general\u2019s Chambers,” the statement read.<\/p>\n
Earlier on Friday, Justice Mohd Arief Emran Arifin said the prosecution had failed to pass the threshold under Section 53 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act (AMLATFPUAA) 2001.<\/p>\n
“The test for Section 53 is not fulfilled, therefore, the application is dismissed,” he said.<\/p>\n
On June 19 last year, the MACC filed an ex-parte application seeking to restrain Na\u2019imah, her son Amir Zainuddin, two individuals, five companies, and related parties from managing overseas assets.<\/p>\n
The agency alleged that the assets, comprising investment funds, were held in several bank accounts in Singapore.<\/p>\n
