{"id":54254,"date":"2026-05-21T23:23:38","date_gmt":"2026-05-21T15:23:38","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=54254"},"modified":"2026-05-21T23:23:38","modified_gmt":"2026-05-21T15:23:38","slug":"man-loses-suit-against-denso-over-alleged-bad-faith-firing","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=54254","title":{"rendered":"Man loses suit against Denso over alleged bad-faith firing"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">SINGAPORE \u2013 <!-- -->A man who spent nearly two decades climbing the ranks at Japanese automotive parts giant Denso has lost his High Court lawsuit claiming that the company had terminated his employment in \u201cbad faith\u201d to avoid paying him retrenchment benefits.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">In a written judgment issued on <!-- -->May 1<!-- -->1, Assist<!-- -->ant Regi<!-- -->strar (AR) Ramu Miyapan struck out the entire lawsuit brought by former Den<!-- -->so Internationa<!-- -->l Asia employee Daniel Seng, finding that the claim had \u201cno recognisable legal basis for wrongful dismissal\u201d.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Seng had worked at Denso International Asia (DIAS) for about 19<!-- --> year<!-- -->s and four months before his employment was terminated on <!-- -->Oct 1, 20<!-- -->24.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">According to his LinkedIn profile, Mr Seng joined the company in<!-- --> May<!-- --> 2005 and rose through the ranks to become the head of strategic business planning in July 2022, a role he held until his employment was terminated some two years and three months later.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">DIAS is the Singapore-based subsidiary of Jap<!-- -->an\u2019s Denso Cor<!-- -->p, one of the world\u2019s largest automotive components manufacturers and a major supplier of vehicle technology and parts to global carmarkers includin<!-- -->g Toyot<!-- -->a.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Court documents stated that Mr Seng sued<!-- --> DIAS in 202<!-- -->5, alleging that the company had disguised what was effectively a retrenchment as an ordinary termination to deprive him of what he described as \u201crightful retrenchment benefits\u201d.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Seng also sought damages for psychiatric harm, distress, humiliation and loss of reputation.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">DIAS applied to strike out Mr Seng\u2019s lawsuit over alleged wrongful dismissal and retrenchment benefits.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">A striking-out application allows the court to dismiss a case without a full trial if the claim is found to be legally unsustainable. The application was heard on<!-- --> Apr<!-- -->il 16.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The court said Mr Seng had not shown any contractual or statutory entitlement to retrenchment benefits.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201c(Fo<!-- -->r the sake of argum<!-- -->ent), the claimant\u2019s factual allegations that his role was made redundant, this alone would not confer any legal entitlement to retrenchment benefits,\u201d AR Ramu said in his written judgment.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">\u201cSuch an entitlement must be founded either in contract or statute.\u201d<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Under Singapore law, there is generally no automatic statutory right to retrenchment benefits unless such benefits are provided for in an employment contract, collective agreement or specific legal provision.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Seng also argued that his termination was contrary to the Tripartite Guidelines on Wrongful Dismissal, which set out examples of wrongful dismissal, such as firing workers for discriminatory reasons, to punish them for exercising employment rights, or on false grounds.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">But the court said the guidelines do not have the force of law and cannot, on their own, be used as a basis to sue an employer in civil court.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The guidelines were issued in <!-- -->2019 b<!-- -->y the Ministry of Manpower, the National Trades Union Congress and Singapore National Employers Federation to guide the handling of wrongful dismissal disputes.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Describing them as \u201cadministrative guidance documents\u201d, the court said they are meant to guide the Employment Claims Tribunal in deciding wrongful dismissal cases, rather than create standalone legal rights for employees.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">The court also rejected Mr Seng\u2019s claims for distress, humiliation and reputational damage, reiterating that such damages are generally not recoverable in wrongful dismissal cases.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">In concluding observations, AR Ramu said the \u201cmere assertion\u201d that conduct was wrongful or contrary to administrative guidelines, \u201cwithout more\u201d, could not sustain a civil action.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Lawyer Mohamed Arsha<!-- -->d Tahir<!-- --> from Fernandez LLC acted for Mr Seng while lawyer Christine Chiam from Focus Law Asia represented DIAS.<\/p>\n<p class=\"font-body-baseline-regular text-primary\" data-testid=\"article-paragraph-annotation-test-id\">Mr Seng declined to comment when contacted after the
