{"id":48189,"date":"2026-04-29T01:27:38","date_gmt":"2026-04-28T17:27:38","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=48189"},"modified":"2026-04-29T01:27:38","modified_gmt":"2026-04-28T17:27:38","slug":"woman-who-asked-cop-for-information-about-ex-husbands-case-avoids-jail-time-on-appeal","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=48189","title":{"rendered":"Woman who asked cop for information about ex-husband\u2019s case avoids jail time on appeal"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div xmlns:default=\"http:\/\/www.w3.org\/2000\/svg\">\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\"><strong class=\"font-primary\">Selina Lum<\/strong><br \/><strong class=\"font-primary\">The Straits Times<\/strong><br \/><strong class=\"font-primary\">April 27, 2026<\/strong><\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">A woman who was originally given one week\u2019s jail for receiving information from a police officer about a theft case involving her former husband has avoided prison time after succeeding in her appeal.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The 38-year-old Vietnamese woman, Tran Thi Tien, was instead <a class=\"text-primary-brand no-underline hover:underline\" rel=\"nofollow noopener\" href=\"https:\/\/www.straitstimes.com\/singapore\/courts-crime\/woman-who-asked-cop-for-information-about-ex-husbands-case-avoids-jail-time-on-appeal\" target=\"_blank\">handed a $1,500 fine<\/a> by the High Court.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The Singapore permanent resident had appealed against the jail term\u00a0<a class=\"text-primary-brand no-underline hover:underline\" rel=\"nofollow noopener\" href=\"https:\/\/www.straitstimes.com\/singapore\/courts-crime\/jail-for-woman-who-obtained-information-about-ex-husbands-theft-case-from-cop?ref=inline-article\" target=\"_blank\">imposed by a district judge in July 2025<\/a>\u00a0over a charge of unauthorised receipt of information under the Official Secrets Act (OSA).<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Tien had wanted to pass the information to her divorce lawyer, though she ultimately did not use it in the divorce proceedings.<\/p>\n<div>\n<div class=\"my-lg md:my-xl\">\n<p><hr class=\"flex-1 border-grayscale-100 lg:hidden\"\/><span class=\"text-grayscale-400 text-14 leading-16 font-primary text-center lg:text-left p-sm\">Scroll to continue reading<\/span><\/p>\n<hr class=\"flex-1 border-grayscale-100 my-md\"\/>\n<hr class=\"my-md border-grayscale-100\"\/><\/div>\n<\/div>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">In written grounds of decision released on\u00a0April 10,\u00a0Justice Mavis Chionh said a jail term was not warranted in this case.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The judge said the amount of information disclosed was limited. Only the number of the police report that was made against her ex-husband was disclosed to Tien, and this number contained no details of the contents of the report.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Justice Chionh added that Tien did not use the report number to cause any harm; neither did she disclose the number to anyone else.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">She noted that there was only a single, simple request made by Tien.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">She disagreed with the district judge\u2019s characterisation of Tien\u2019s conduct as having been \u201claced with malice\u201d because she had made a \u201ccalculated effort\u201d to extract information that she could weaponise against her ex-husband.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Justice Chionh said motive should be considered as a sentencing factor only in exceptional situations.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">She reasoned that recipients of confidential information would have been motivated by some perceived personal benefit.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">\u201cIt will not be feasible or productive in most cases to seek to rank different motives on some putative sliding scale of distastefulness,\u201d she said.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The case involved Chan Zhiyao, who was then a senior investigation officer attached to the Special Victims Unit of Bedok Police Division.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">In 2020, Chan was assigned to investigate a case of child abuse involving Tien and her then husband.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">On Dec 9, 2020,\u00a0Tien\u00a0told Chan that her husband had stolen a mobile phone in 2016, and asked him to provide her with information on the investigations so that she could relay the information to her divorce lawyer.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Chan then conducted an unauthorised screening for Tien\u2019s husband in a police database.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">He obtained the police report number for the theft case, which he then sent to Tien over WhatsApp.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Tien and Chan later entered into a sexual relationship in May 2022.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The OSA offences came to light during an investigation into Chan over unrelated matters.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">In her written grounds, Justice Chionh set out the sentencing approach for future cases of unauthorised receipt of confidential information, which carries a maximum $2,000 fine, a jail term of up to two years, or both.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">She identified a list of factors to determine the level of harm caused and the level of the offender\u2019s culpability.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">They include the nature of information disclosed, the extent of actual harm caused, the offender\u2019s role, and the duration of offending behaviour.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The number of factors in each case would determine the indicative sentencing range.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">A case involving slight harm and low culpability would attract a fine or a short jail term, while a case involving high culpability and severe harm would attract a jail term from 1\u00bd to two years.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The final sentence would be adjusted based on factors specific to each offender.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">For the current case, Justice Chionh noted that both the prosecution and the defence had agreed that Tien\u2019s offence involved slight harm and low culpability.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">The woman, who was represented by Mr Chooi Jing Yen, sought a $1,500 fine, while the prosecution asked for the one-week jail term to be upheld.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Chan, then 44,\u00a0<a class=\"text-primary-brand no-underline hover:underline\" rel=\"nofollow noopener\" href=\"https:\/\/www.straitstimes.com\/singapore\/courts-crime\/jail-for-cop-who-pocketed-4000-entrusted-to-him-misused-police-computer-system?ref=inline-article\" target=\"_blank\">was sentenced to\u00a0a year and four months\u2019 jail\u00a0in April 2025<\/a>. He had pleaded guilty to a charge under the OSA over disclosing information to Tien and an unrelated charge of criminal breach of trust.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Justice Chionh noted that the district judge who sentenced Tien had considered the issue of parity.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">She disagreed that this was a case where the public would perceive that Chan had suffered injustice because he was given two months\u2019 jail for the OSA charge when Tien was given a fine.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">Justice Chionh pointed out that Chan had another charge under the Computer Misuse Act that was taken into consideration, had taken the initiative to access the police database, and had abused his position.<\/p>\n<p class=\"font-secondary pt-md text-18 font-normal leading-1.5 text-grayscale-800\">There was no doubt that the custodial threshold had been crossed, she said.<\/p>\n<hr class=\"border-t border-primary-200 my-xl\"\/>\n<div class=\"flex flex-col gap-xl rounded-xl border border-primary-100 mt-xl\"><img decoding=\"async\" src=\"https:\/\/www.stomp.sg\/assets\/stomp-comment-COLiWNMD.png\" alt=\"Stomp Comment\" class=\"absolute -mt-lg -ml-xs w-[203px] md:w-[255px]\"\/><\/p>\n<p>Have something to say?
