{"id":31869,"date":"2026-02-26T18:08:35","date_gmt":"2026-02-26T10:08:35","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=31869"},"modified":"2026-02-26T18:08:35","modified_gmt":"2026-02-26T10:08:35","slug":"ministerial-discretion-under-laws-like-pofma-must-stay-within-legal-bounds-chan-chun-sing","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=31869","title":{"rendered":"Ministerial discretion under laws like POFMA must stay within legal bounds: Chan Chun Sing"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div>\n<p>SINGAPORE: Laws granting ministers broad discretionary powers \u2013 including POFMA and other legislation \u2013 must always be exercised within the bounds of the law, Coordinating Minister for Public Services Chan Chun Sing said on Thursday (Feb 26).<\/p>\n<p>He was responding to questions from MP He Ting Ru (WP-Sengkang) during parliament&#8217;s debate on the Public Service Division&#8217;s spending plans under Budget 2026.<\/p>\n<p>Ms He had asked how Singapore guides and monitors the use of executive discretion, noting that several laws \u2013 including the Protection from Online Falsehoods and Manipulation Act (POFMA), the Foreign Interference (Countermeasures) Act, and the Online Safety (Relief and Accountability) Act passed last year \u2013 give ministers and statutory bodies broad powers to act on fake news, foreign interference and harmful online content.<\/p>\n<p>She also noted that when executive discretion is exercised, the public&#8217;s main avenue for challenge is judicial review, which she said was &#8220;rare&#8221; in Singapore.<\/p>\n<p>\u201cHow does Singapore guide and monitor the use of executive discretion and what are the safeguards in place to ensure that these are done judiciously?\u201d she asked.<\/p>\n<p>Mr Chan, who also serves as Defence Minister, said the Prime Minister assigns ministerial responsibilities, including statutory functions &#8211;
