{"id":14826,"date":"2025-11-27T08:13:38","date_gmt":"2025-11-27T00:13:38","guid":{"rendered":"https:\/\/sgbuzz.com\/?p=14826"},"modified":"2025-11-27T08:13:38","modified_gmt":"2025-11-27T00:13:38","slug":"high-court-judge-upholds-decision-to-award-uob-s17-7-million-in-lippo-marina-collection-lawsuit","status":"publish","type":"post","link":"https:\/\/sgbuzz.com\/?p=14826","title":{"rendered":"High Court judge upholds decision to award UOB S$17.7 million in Lippo Marina Collection lawsuit\u00a0"},"content":{"rendered":"<p><br \/>\n<\/p>\n<p>The bank had claimed up to S$92 million in damages, but Justice Aidan Xu says it \u2018failed to mitigate losses fully\u2019<\/p>\n<div data-testid=\"article-body-container\">\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">[SINGAPORE] A High Court judge has upheld his decision to award UOB S$17.7 million in damages, for losses the bank incurred as a result of disbursing inflated housing loans to buyers who bought units at Marina Collection.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">On Wednesday (Nov 26), Justice Aidan Xu said the bank \u201cfailed to mitigate its losses fully\u201d and that interest awarded was based on appropriate deductions.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">The case began in 2014, when UOB filed a lawsuit alleging that <a class=\"text-verticals-btblue underline\" data-testid=\"article-annotation-link-component\" href=\"https:\/\/www.businesstimes.com.sg\/companies-markets\/banking-finance\/uob-awarded-s17-7m-civil-suit-against-lippo-marina-collection-over-inflated-housing-loans\" target=\"_blank\" rel=\"noopener\">Marina Collection\u2019s developer, Lippo Marina Collection \u2013\u00a0a subsidiary of Indonesia\u2019s Lippo Group \u2013\u00a0conspired with two property agents<\/a> to offer \u201cexcessive\u201d furniture rebates provided to buyers, inflating the sale prices of units at the luxury condominium in Sentosa Cove.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">Marina Collection was launched in December 2007, but sold only 42 out of 124 units by March 2011. Lippo then entered into an agreement with the two property agents, Goh Buck Lim and Aurellia Ho, to offer furniture rebates to buyers referred by the agents.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">For instance, a unit with a stated purchase price of S$6.1 million was sold with a furniture rebate of S$1.4 million. This put the actual purchase price at S$4.8 million.<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">As a result, UOB was misled into granting housing loans based on inflated prices.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">The bank disbursed about S$182 million in home loans to purchasers of 38 units between December 2011 and July 2013, all of whom defaulted on their loans.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">In 2022, the Appellate Division of the High Court found that<a class=\"text-verticals-btblue underline\" data-testid=\"article-annotation-link-component\" href=\"https:\/\/www.businesstimes.com.sg\/property\/residential\/uob-wins-appeal-against-lippo-furniture-rebate\" target=\"_blank\" rel=\"noopener\"> Lippo Marina Collection had conspired with two property agents to mislead the bank<\/a>.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">Justice Xu\u2019s decision to award UOB S$17.7 million was based on around S$53 million in claims comprising excess loans disbursed, the cost of funds, credit spread and costs of investigation.\u00a0<\/p>\n<div data-component=\"component-container\" class=\"container px-0 no-print\">\n<div class=\"no-print mb-6 mt-8 border border-gray-175 p-6 md:-mx-8 md:mt-0 md:p-8\" data-testid=\"article-read-more-component\">\n<div>\n<p class=\"mb-6 border-b border-gray-250 pb-4 font-poppins text-4xs font-medium tracking-widest text-gray-515\">SEE ALSO<\/p>\n<div data-testid=\"section-related-stories\" class=\"overflow-hidden transition-all duration-300\" style=\"height:0\">\n<div class=\"mb-6\" data-testid=\"article-read-more-individual-card-component\">\n<div data-testid=\"basic-card-component\" data-cueid=\"362183\" class=\"relative flex flex-wrap items-start gap-4\">\n<div class=\"relative w-[70px] lg:w-[90px] aspect-3x2 order-1 flex-shrink-0\">\n<div class=\"w-full overflow-hidden relative flex\" data-testid=\"article-thumbnail-component\"><a class=\"block h-full w-full\" href=\"https:\/\/www.businesstimes.com.sg\/property\/residential\/uob-wins-appeal-against-lippo-furniture-rebate?ref=article-see-also\" data-discover=\"true\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"relative z-10 h-full w-full object-cover\" src=\"https:\/\/cassette.sphdigital.com.sg\/image\/businesstimes\/c163b972ebd1e372b439c7efe3c1da79ca6813af7a466a34eab61738179737d9?w=960&amp;dpr=1&amp;f=webp\" alt=\"Lippo will have to pay damages and partial costs to UOB.\" width=\"1600\" height=\"1196\"\/><\/a><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">About S$37.2 million was deducted to account for repayments made and rental income UOB collected from renting out units it repossessed. The bank also received S$2.3 million in statutory interest.\u00a0<\/p>\n<h2 class=\"-tracking-5% mb-4 md:mb-6\" data-testid=\"heading-component\">Bank\u2019s claim\u00a0<\/h2>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">UOB argued that damages should be calculated on the basis that it would not have approved or disbursed any housing loans if not for conspiracy between Lippo Marina Collection and the two property agents. The bank said its losses amounted to S$92 million.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">In the alternative, if losses were to be quantified on the basis that UOB would still have granted the housing loans, the bank said it would have suffered losses around S$76.9 million.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">However, Lippo Marina Collection objected to these calculations, saying that UOB had failed to take reasonable steps to mitigate its losses.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">Justice Xu said: \u201cI found that UOB had failed to mitigate from 2017, which was when it should have taken steps to sell off the units to reduce its losses.\u201d\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">UOB defended its decision not to sell the units in 2014 when the case began, as property prices were falling and seller\u2019s stamp duty was substantial. Instead, the units were rented out, to reduce the outstanding amounts.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">Property prices were generally falling, with a minor increase in December 2018, before falling again in 2019.<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">While Justice Xu acknowledged that the bank did not have to sell these units in softening conditions, he said: \u201cWhen the market turned in 2017, UOB should have started selling\u201d.<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">The judge noted that UOB was \u201cawaiting the outcome of the litigation\u201d before selling the units.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">The bank\u2019s justification was that if units were sold cheaply, it would need to recover the shortfall between the outstanding loan amount and sale proceeds from the purchasers who might not be able to pay. However, if UOB\u2019s claim were successful, it could receive compensation from Lippo Marina Collection and avoid these concerns.\u00a0<\/p>\n<p class=\"whitespace-pre-wrap break-words mb-4 md:mb-6\" data-testid=\"article-paragraph-component\">However, Justice Xu said that it was \u201cnot reasonable\u201d for UOB to wait for an outcome to the lawsuit.\u00a0\u201cThe reasonable position to take would have been to minimise loss.
